1) Scope of Application

1.1 These General Terms and Conditions (hereinafter "GTC") of Ambe Parkett GmbH (hereinafter "Seller") apply to all contracts for the delivery of goods that a consumer or entrepreneur (hereinafter "Customer") concludes with the Seller regarding the goods presented in the Seller’s online shop. The inclusion of the Customer’s own terms is hereby rejected, unless otherwise agreed.

1.2 A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that predominantly are outside their commercial or self-employed professional activity.

1.3 An entrepreneur within the meaning of these GTC is any natural or legal person or partnership with legal capacity who, when entering into a legal transaction, acts in exercise of their commercial or self-employed professional activity.


2) Conclusion of Contract

2.1 The product descriptions contained in the Seller's online shop do not constitute binding offers on the part of the Seller but serve as an invitation for the Customer to submit a binding offer.

2.2 The Customer can submit the offer via the online order form integrated in the Seller’s online shop. After placing the selected goods in the virtual shopping cart and completing the electronic ordering process, the Customer submits a legally binding offer by clicking the button that concludes the order process. The Customer may also submit the offer via e-mail, online contact form, or telephone.

2.3 The Seller may accept the Customer’s offer within five days by

  • sending the Customer a written order confirmation or one in text form (fax or e-mail), whereby receipt by the Customer is decisive, or

  • delivering the ordered goods to the Customer, whereby receipt of the goods is decisive, or

  • requesting payment from the Customer after the order has been placed.

If several of the aforementioned alternatives occur, the contract is concluded at the moment when one of the alternatives occurs first. The period for acceptance begins the day after the Customer submits the offer and ends at the end of the fifth day following submission. If the Seller does not accept the Customer’s offer within this period, the offer is deemed rejected.

2.4 When selecting a payment method offered by PayPal, payment is processed by PayPal (Europe) S.à r.l. et Cie, S.C.A., Luxembourg, under the PayPal user agreement. If the Customer pays via a PayPal payment option selectable during the order process, the Seller declares immediate acceptance of the Customer’s offer at the moment the Customer clicks the button concluding the order process.

2.5 When selecting “Amazon Payments,” payment is processed by Amazon Payments Europe s.c.a., Luxembourg, under the applicable terms. By clicking the button concluding the order process, the Customer simultaneously initiates a payment order to Amazon. The Seller declares acceptance of the Customer’s offer at this moment.

2.6 When submitting an offer via the Seller’s online order form, the contract text is stored by the Seller and sent to the Customer in text form after the order is sent. If the Customer has created a user account, order data is archived there and can be accessed via login.

2.7 Before submitting the binding order, the Customer can identify input errors by reviewing the displayed information. Browser zoom may assist. Corrections can be made throughout the ordering process via standard keyboard and mouse functions.

2.8 Various languages are available for concluding the contract; the specific options are shown in the online shop.

2.9 Order processing and communication usually take place by e-mail. The Customer must ensure that the provided e-mail address is correct and capable of receiving messages. If spam filters are used, the Customer must ensure that emails from the Seller or commissioned third parties can be delivered.


3) Right of Withdrawal

3.1 Consumers generally have a right of withdrawal.

3.2 Details are provided in the Seller’s withdrawal policy.

3.3 The right of withdrawal does not apply to consumers who, at the time of contract conclusion, are not residents of a member state of the European Union and whose sole residence and delivery address are located outside the European Union.


4) Prices and Payment Terms

4.1 Unless otherwise stated, prices listed by the Seller are total prices including VAT. Additional shipping costs are shown separately.

4.2 For deliveries outside the EU, additional costs (e.g., bank transfer fees, currency conversion fees, customs duties) may apply, which the Seller cannot control and which must be borne by the Customer.

4.3 Available payment options are displayed in the online shop.

4.4 If advance payment via bank transfer is agreed, payment is due immediately unless otherwise arranged.

4.5 When selecting a PayPal payment method, PayPal may use third-party payment providers. If PayPal offers payment methods involving Seller pre-financing (e.g., purchase on account), the Seller assigns the payment claim to PayPal or designated providers. A credit check is performed beforehand. If rejected, the Seller may refuse the chosen payment method.

4.6 When selecting “Sofortüberweisung,” payment is processed by Klarna Bank AB (publ). The Customer requires an activated online banking account.

4.7 When selecting “Shopify Payments,” payment is processed by Stripe Payments Europe Ltd. Further terms may apply.
